Cancellation Policy

Right of Withdrawal and Exclusion Notice

1. No Right of Withdrawal for Travel Services

For the following types of contracts, there is no statutory right of withdrawal pursuant to § 312g para. 2 no. 9 of the German Civil Code (BGB), even if the contract was concluded remotely (e.g. via our website mirakoda.com, by email, or by telephone):

(a) Package travel contracts within the meaning of § 651a BGB (combination of at least two different travel services for the same trip)

(b) Contracts for transport services (flights, transfers, private charter) with a fixed date or fixed period

(c) Contracts for accommodation services (hotels, boutique resorts, private villas) for a specific period

(d) Contracts for other individual tourism services (e.g. excursions, transfers, restaurant reservations) with a fixed date

Upon receipt of the written booking confirmation from MIRA KODA, the booking is binding and irrevocable. Cancellation is only possible under the conditions set out in the MIRA KODA General Terms and Conditions and subject to the cancellation fees specified therein.

2. Exception: Right of Withdrawal for Off-Premises Contracts

A statutory right of withdrawal exists by way of exception if a package travel contract was concluded outside business premises (§ 312g para. 2 no. 9, second clause BGB), provided that:

(a) The contract was concluded during a personal conversation outside the business premises of MIRA KODA (e.g. at a trade fair, during a home visit), and

(b) the oral negotiations on which the conclusion of the contract was based were not conducted at the prior request of the customer.

If this exception applies to your booking, the following withdrawal notice applies:

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the date of conclusion of the contract. To exercise your right of withdrawal, you must inform us (MIRA KODA UG (haftungsbeschränkt), Äußere Bayreuther Str. 57-59, 90409 Nürnberg, email: [email protected]) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an email).

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you, without undue delay and no later than fourteen days from the day on which we received notification of your withdrawal. We will use the same means of payment that you used for the original transaction unless expressly agreed otherwise; you will not be charged any fees as a result of such reimbursement.

3. Right to Cancel Instead of Right of Withdrawal

Instead of the right of withdrawal, you are entitled at any time before the start of the trip to the statutory right to cancel the package travel contract pursuant to § 651h BGB. Cancellation may be made informally (e.g. by email). In the event of cancellation, MIRA KODA is entitled to claim reasonable compensation. The cancellation fees are set out in the MIRA KODA General Terms and Conditions.

Cancellation free of charge is possible if unavoidable and extraordinary circumstances occur at or in the immediate vicinity of the destination that significantly affect the performance of the package travel or the transport of persons to the destination (§ 651h para. 3 BGB).
